What is the Property Owners Association Act?

The Georgia Property Owners Association Act (POAA) was adopted in 1994 and was designed to be similar to the Georgia Condominium Act.  This statute allows for an expansion of Association rights, including perpetual duration of the Covenants and Restrictions, automatic statutory liens, joint and several liability to pay assessments, and other benefits.  The POAA doesn’t apply automatically though – associations must opt in.  Lazega and Johanson explain the benefits to adopting the POAA here.
